Detective arrived two hours after the incident around the same time that John Burlein’s father arrived. The Detective turned the scene over to the Burlein’s and never contacted the family who owned the house. -No Gunshot Residue (GSR) test was performed on Burlein, the only person known to be present at the time of death. -Police did not detain or question Burlein or the other roommates separately to check for inconsistencies in their stories. -Officers allowed both roommates back into the residence just two (2) hours after the police had arrived on the scene. This is all documented-on Body Cam footage. -At that time, John Burlein, along with his father, roommate and another friend, left the scene and later returned-not to check on Alex at the hospital, but to thoroughly clean his room with bleach that destroyed all traces of blood evidence. Their priority was not concern for their friend and roommate but instead to remove any trace of evidence by cleaning and bleaching the space where a tragic incident had just occurred-another deeply troubling red flag. -A GSR test on Alex-conducted only after his mother insisted. -GSR results were initially not in DBPD Property & Evidence, but in the Detective’s possession. Inconsistent with the Detective’s report that Alex handled the weapon, the GSR test results came back negative suggesting that Alex did not fire the weapon.

Audio evidence of a heated verbal and physical altercation between Alex and Burlein followed shortly by a gunshot was dismissed by police, despite being of clear evidentiary value. These failures raise serious questions about whether Alex’s death was properly investigated and whether justice has truly been served.

Daytona Beach Police told Alex’s family that they heard nothing significant on the audio recordings. Yet, that very same audio-along with other compelling evidence—was critical in a civil Federal trial where John Burlein was found liable for the intentional battery that directly caused Alex’s death.
